Рэформы гарадскога самакіравання Беларусі ў 90-я гады ХVIII стагоддзя

Abstract

У артыкуле разглядаюцца змены, якія адбыліся ў структуры і функцыях самакіравання гарадоў Вялікага княства Літоўскага ў сувязі з правядзеннем рэформаў Чатырохгадовага сейма. Вызначаныя некалькімі канстытуцыямі, якія прынеслі істотныя змены ў жыццѐ беларускіх гарадоў. Упершыню з’явілася адзінае для ўсѐй краіны гарадское заканадаўства, якое прыйшло на змену партыкулярызму магдэбургскага права. Былі ўсталяваны адзіныя правілы ўтварэння і функцыянавання інстытутаў гарадскога самакіравання. Больш дакладна размяжоўваліся напрамкі іх дзейнасці ў адміністрацыйнай, эканамічнай і судовай сферах. Змяняліся заканадаўчыя асновы судовага працэсу. Ажыццяўляўся новы адміністрацыйны падзел гарадоў на акругі і дазоры, утвараліся гарадскія аддзелы з цэнтрамі ў апеляцыйных гарадах. Пачалося пэўнае ўключэнне гарадскіх інстытутаў у агульную структуру ўлады Рэчы Паспалітай з акрэсленым абмежаваннем функцый у галіне кіравання і суда, падначаленнем іх дзяржаўным органам кіравання (камісія паліцыі, скарбовая камісія, асэсарскі суд). Пашырэнне правоў гараджан выклікала рост іх самасвядомасці. На канкрэтных прыкладах паказана рэалізацыя рэформаў у асобных беларускіх гарадах. = The article examines the changes that occurred in the structure and functions of the self-government of the cities in the Grand Duchy of Lithuania in accordance with the reforms of the Four-year Sejm. Determined by several constitutions, they brought considerable changes in the life of Belarusian cities. It was the first urban legislation single for the whole country, which came to replace the particularism of the Magdeburg Right. Common rules for the creation and functioning of the city self-government institutions were established. Their activities in the administrative, economic and judicial spheres were more clearly delineated. Changes in a legislative framework of the judicial process also took place. A new administrative division of the cities into districts and watches was implemented, and city departments with the centers in appellate cities were created. The inclusion of urban institutions into the general structure of power of Rzecz Pospolita in accordance to certain limitation of functions in the sphere of the court management, subjecting them to public management bodies (the police, government commission, assessor court) started. The expansion of the rights of the citizens caused growth of their self-consciousness. Concrete examples show the implementation of the reforms in some Belarusian towns.
